CLEonline.com is pleased to present a special online ethics course on a topic that impacts almost all practicing lawyers. This seminar analyzes common ethical issues arising from contingent fee agreements, including basic issues discussed in disciplinary rules as well as efforts by lawyers to include clauses that limit the ability of clients to discharge lawyers, or broaden the circumstances in which lawyers may withdraw from a representation. Can a lawyer enforce a contract that allows the lawyer to walk away from a contingent fee agreement whenever it becomes uneconomical? Can he/she walk away and insist on still being paid? These issues will be analyzed in this presentation. This course features an audio presentation by Professor David Hricik of Mercer University School of Law, in which he discusses the issues outlined below. You can access this presentation on demand at any time during the course of the seminar session. The seminar is accredited for 1.0 hour of MCLE credit in legal ethics.

Some of the subjects to be discussed during this course include:

    * An Overview of Public Policies Underlying Permitting but Regulating Contingent Fee Agreements

    * How Courts in Select Jurisdictions Regulate Compensation Where the Lawyer Fires the Client

    * Courts Should Hold Lawyer Withdrawal-Compensation Provisions in Contingent Fee Agreements Unenforceable if They Violate the Regulatory Balance of State Law

The speaker for this course is Prof. David Hricik, a professor of law at Mercer University School of Law in Macon, Georgia where he teaches courses in legal ethics, patent law litigation, remedies and alternative dispute resolution. Before joining the law faculty at Mercer, David practiced law as a litigator with the Houston law firms of Baker Botts, Slusser & Frost, and then Yetter & Warden for 14 years. While in private practice, he focused on complex civil litigation, patent litigation, malpractice defense, and ethics consulting. He has written and spoken extensively on legal ethics, professionalism, and intellectual property. He is a member of the Professionalism & Ethics Committee of the American Intellectual Property Law Association (Chair, 2005-2008); Chair of the Ethics and Professional Responsibility Committee of the Intellectual Property Section of the American Bar Association (2002-03); and was a member of the Texas Disciplinary Rules of Professional Conduct Committee of the State Bar of Texas from 1997-2002. He received his undergraduate degree from the University of Arizona (B.A., 1984) and his law degree from Northwestern University (J.D., 1988). A more extensive biography for Prof. Hricik may be found at his law school's website.
