This in-depth CLE presentation will explore and analyze the benefits, risks, and concomitant opportunities of virtual litigation (court & ADR), the acceleration of digitalization and ramifications (including scrutiny of data collection practices in litigation, etc.) and the solutions to these complex issues during this “new normal” time while cognizant of all commensurate ethical responsibilities. This course features streaming video and downloadable audio presentations from a CLE seminar by the Houston Bar Association (HBA) on December 18, 2020.

  • Analysis as to Whether a Virtual Jury Trial Would Deliver the Same Quality of Justice (as well as Impact on Court Costs)

  • Discussion Regarding the Ethical Considerations

  • Acceleration of Technology, Acceptable Data Collection Practices, & the Need for Vigilance Regarding the Rules of Professional Responsibility.

  • Discussion of “Who’s in the Room”, Confidentiality, and Other Ethical Considerations

  • Analysis and Efficacy of Virtual Mediations, Arbitrations, and Court Proceedings

    Honorable Caroline E. Baker, Mediator, Arbitrator, Senior District Judge [Retired], Baker Mediation LLC.  Caroline Baker served the citizens of Harris County as a judge for 21 years before retiring at the end of 2018 as a senior judge. A graduate of Princeton University and the University of Texas School of Law, she is Board Certified in Personal Injury Trial Law and has been elected to membership in the American Board of Trial Advocates. She also is a mediator with a certificate from the AA White Dispute Resolution Center and has served as an adjunct professor in Trial Advocacy at the University of Houston Law Center. Strongly committed to professional service, Caroline serves and/or has served on several committees of the State Bar of Texas, including the Committee on Judicial Ethics, Judicial Section. She has served as Past President of TACTAS and of the ADR Section of the HBA, and has been a member and Chair of a State Bar Grievance Committee. Hon.
