GSE foreclosures have been on “hold” since March 18, 2020 and it is unknown at this time when they will resume. In this CLE presentation, we will review the types of foreclosure processes available in Texas and what we are seeing from the GSE’s (Freddie Mac/Fannie Mae) regarding what loans are being referred for foreclosure. We will discuss options available to borrowers to hold off foreclosure, loss mitigation options (forbearances, modifications, deeds in lieu of foreclosure/short sales), judicial options (temporary restraining orders and injunctions), and bankruptcies. We will also discuss how foreclosure attorneys can effectively represent their clients and still provide viable options for borrowers without creating a conflict of interest. This course features streaming video and downloadable audio presentations from a CLE seminar by the Houston Bar Association (HBA) on April 16, 2021.
